California DUI – Under 21 Years of Age Drunk Driving Arrest

When a driver under 21 years old is arrested for underage DUI in or having any alcohol in their system in California, their driver’s license is taken by the law enforcement officer who makes the arrest. The arresting officer will issue an Order of Suspension/Revocation and send the license to the Department of Motor Vehicles (DMV). If the arresting officer fails to provide the order, the DMV typically sends a notice of suspension in the mail.

Under most circumstances, the Order of Suspension/Revocation will include a temporary driver’s license which is valid for thirty days from the day the order was issued. Unless you fight this immediately and contact DMV within ten days of arrest or detention, after 30 days, the suspension or revocation takes effect. This driver’s license suspension or revocation can last up to one or more years. Young drivers convicted of underage DUI may also face the following penalties:

  • Fines up to several thousand dollars
  • Mandatory driving safety and alcohol or drug education classes, such as the “Youthful Drunk Driver Visitation Program”
  • A court order not to consume any alcohol until age twenty-one
  • Completion of a driving under the influence alcohol program
  • The need to submit proof of financial responsibility, in order to get their license back after suspension/revocation
  • Having to put their underage DUI conviction on any college applications
  • Difficulty obtaining certain types of employment
  • A mark on their record that negatively impacts their life for many years
