California Blood Tests – Blood Alcohol Testing

When a driver is suspected of driving under the influence of alcohol and is pulled over, the law enforcement official usually conducts tests to determine the blood alcohol content or BAC of the driver’s blood. The legal limit is now 0.08 % BAC in every state in the country and though blood tests are generally regarded by prosecutors as better indicators of blood alcohol concentration, experienced California DUI defense lawyers know that these alcohol tests are not foolproof.

Our very experienced California drunk driving defense attorneys at Takakjian, Sowers & Sitkoff LLP know that in order for a blood test to render accurate results, exact extraction and testing protocols must be followed. Unless these procedures are followed to the letter, the blood test may produce inaccurate results and a California blood test lawyer may be able to have the blood test results rendered inadmissible in court.

Experienced California DUI Defense Attorneys

Under California law, there is an ‘implied consent’ law in which drivers suspected of being under the influence of drugs or alcohol are required to submit to a a test to determine the alcohol content of their breath or blood. If a driver suspected of driving under the influence refuses to submit to a blood test, the results can be quite serious and negatively affect their life for many years. Failure to submit to a blood test can result in:

  • Steep fines
  • Mandatory imprisonment if they are convicted of DUI
  • Suspension of their driver’s license by the Department of Motor Vehicles

It’s important to note that these penalties are in addition to the standard criminal penalties for DUI. Please see our “DUI Penalties” page for more information.

When a driver is given a California breath test, the police officer must advise them of the right to take a separate blood test so that the blood sample can be independently tested for BAC. This is called the “Trombetta” advisement. The blood must be drawn into a glass tube that has a precise mixture of preservatives and anticoagulants at the bottom. Further, the blood must be drawn by a person with the proper certification and the suspect’s arm must be wiped with an alcohol-free wipe. We always send our client’s blood samples to an independent lab for testing. We want to know if the sample is contaminated or if the reading the prosecutor has is inaccurate. Our experienced California drunk driving defense lawyers at Takakjian, Sowers & Sitkoff LLP know that there are a number of ways that a blood test’s validity can be challenged in court.
